It is quite possible that Jet Blue crew members could have a valid STD injury claim after the recent allegations of sexual assault against two of the airline’s pilots. Two crew members have publicly charged that they and a third woman were drugged by the pilots during a stop over in San Juan, Puerto Rico in May of 2018, ultimately leading to sexual assault and rape. The lawsuit filed this week alleges the accused pilots also knowingly transmitted an STD during the attack.
The Jet Blue crew members could have a valid STD injury claim if they can prove they did not have an STD prior to the alleged incident and that one or both of the accused attackers knew they had an STD at the time.
The lawsuit alleges the three women decided to go to the beach together where they met the defendants. The two men offered an open beer to the women, who each shared some of the drink. The rest of the day and evening became a blur, who believe the beer was laced with some type of drug. One of the plaintiffs remembers being “in a haze” and being unable to fight off one of her attackers. She was aware of one of the men having sex with her against her will, and flashes of the same man her co-plaintiff. The lawsuit claims when the alleged incident was over the defendant thanked her for “making my fantasy come true.”
Testing after the attack confirmed one of the plaintiffs had contracted HPV for which she had previously tested negative. The pair contacted Jet Blue’s headquarters to report rape, sexual assault and sex and gender discrimination. The lawsuit claims no action was taken.
