The fifth victim of a fatal accident in Ontario was a Huntington Beach man. Last week, a fatal accident off of the I-10 in Ontario occurred when a Toyota Yaris experienced reported mechanical problems and tried to exit the freeway, broadsiding a Toyota Solara. The Huntington Beach man was one of the four people traveling in the Solara that was heavily damaged by the impact. All four of the vehicle’s occupants were killed in the accident. A 7 year old boy in the Yaris was seriously injured in the accident, and passed away later at a local hospital.
Driving under the influence has been ruled out as the investigation into the accident continues. The driver of the Yaris reported that the accelerator stuck, and she could not slow the vehicle down. She tried to exit the freeway at the Vineland off ramp, but ran into the Solara as she exited. The driver of the Yaris, a 16 year old boy and a 12 year old girl were seriously injured in the accident, but have survived and are cooperating with investigators.
This is a tragic accident, and at least 4 cases of wrongful death will come out of this accident. The presence of potential mechanical failure in the Yaris may raise legally complex questions during the case, and the families should look for an attorney with deep experience and expertise as well as a proven track record at trial. Many injury attorneys have never taken a case to verdict, and this is a surprise to most accident victims and their family.
