The victim in a fatal motorcycle accident in Santiago Canyon that took place over a week ago has recently expired from his injuries. The accident occurred when the motorcyclist was ejected from his motorcycle as he was driving down Santiago Canyon Road. The motorcyclist had swerved to avoid a collision when a vehicle in the opposite lane of oncoming traffic made a U-turn. There was a passenger on the motorcycle that was also thrown from the motorcycle and sustained serious, but non-life threatening injuries.
Motorcycle accidents involving other vehicles, pedestrians, and cyclists can result in significant injuries. Unlike automobile accidents, where there are safety features such as safety belts, airbags, and frames to withstand collision, a motorcyclist is “naked” in terms of safety relying only on safety gear and a helmet to protect from head injuries. Even with proper safety equipment, motorcycle accidents can result in very serious, and unfortunately, sometimes fatal accidents.
Although the authorities have not indicated there is a criminal investigation into the cause of the accident, it is very possible that the estate of the victim may have a potential civil wrongful death lawsuit. Even if there is no criminal wrongdoing, or criminal charges against a party for a car accident, it does not necessarily mean that a civil lawsuit won’t be successful. The burden of proof is much less in a civil action, so it is easier to bring forth a successful action compared to a criminal action.
